Purpose: service delivery, order fulfillment, vehicle sales and service records, and customer support.

Retention: for the duration of the customer relationship and thereafter as required by law (for example, tax, warranty, and title records) and for our legitimate business record-keeping.

1.3 Financing applications

Categories of data collected:

First and last name, address, date of birth
Social Security number
Income and employment information
Credit history, credit scores, and credit reports obtained from consumer reporting agencies
Transaction and account history

Purpose: evaluating and processing financing applications, servicing financing accounts, reporting to credit bureaus, and complying with legal obligations.

Retention: for the duration of your account and thereafter as required by federal and state law.

1.4 SMS/text messaging and voice communications

Categories of data collected:

Telephone number
Message content and delivery/read metadata
Call recordings and transcripts
Date, time, and duration of communications

Purpose: appointment reminders and confirmations, service and financing account notifications, responses to your inquiries, customer support, and — only where you have opted in — marketing messages.

Retention: we retain SMS and call records only as long as needed for the purposes described above, unless a longer period is required by law or needed for dispute resolution.

1.5 AI-assisted communications

Some of our phone and text communications are handled by an automated AI assistant.

Categories of data collected:

Telephone number
The content of your conversation with the AI assistant (audio, transcripts, and text messages)
Your requests and the assistant's responses

Purpose: answering questions, scheduling appointments, routing your request to the right team, and improving service quality. Interactions may be recorded, transcribed, and reviewed for quality assurance and to improve our systems.

You may request a human representative at any time by asking the assistant to transfer you or by calling us at 317-800-7999.

Retention: same as Section 1.4.

1.6 Compiling and analyzing statistics for website improvement

Categories of data collected:

IP address
Usage data (pages visited, device and browser information)

Retention: we retain this data in identifiable form only as long as needed for our analysis and may retain aggregated, de-identified statistics indefinitely.

2. Sharing with other parties

We share personal data only with the following categories of recipients, and only for the purposes described:

Our affiliate, American International Finance, Inc. — for everyday business purposes such as processing transactions, servicing financing accounts, and maintaining your account. Sharing of financial information with AIF is described in our GLBA Notice, including your right to limit certain affiliate sharing.
Service providers that perform services on our behalf (for example, website hosting, communications and messaging platforms, payment processing, and IT support). These providers are contractually required to protect your data and may use it only to provide services to us.
Consumer reporting agencies (credit bureaus) — in connection with financing applications and account reporting.
Lenders and financial institutions — to arrange financing you request.
Professional advisers and authorities — as described in Section 3.

We do not sell your personal data. We do not share your personal data with unaffiliated third parties for their marketing purposes.

2.1 Mobile information and text messaging data

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Sharing of mobile information is limited to service providers acting on our behalf (for example, our messaging platform) as necessary to deliver the communications you have requested.

3. Disclosure practices

We disclose personal information if we are required to do so by law or by a court order, in response to a law enforcement agency, to the extent permitted under other provisions of law, to provide information, or for an investigation on a matter related to public safety.

If our website or organisation is taken over, sold, or involved in a merger or acquisition, your details may be disclosed to our advisers and any prospective purchasers and will be passed on to the new owners.

4. How we respond to Do Not Track signals & Global Privacy Control

Our website does not respond to and does not support the Do Not Track (DNT) header request field.

5. Cookies

We have concluded a data processing agreement with Google. Google may not use the data for any other Google services. The inclusion of full IP addresses is blocked by us.

6. Security

We are committed to the security of personal data. We take appropriate security measures to limit abuse of and unauthorized access to personal data. This ensures that only the necessary persons have access to your data, that access to the data is protected, and that our security measures are regularly reviewed.

7. Third-party websites

This privacy statement does not apply to third-party websites connected by links on our website. We cannot guarantee that these third parties handle your personal data in a reliable or secure manner. We recommend you read the privacy statements of these websites prior to making use of these websites.

8. SMS/Text messaging program

By providing your mobile number and opting in (via our website forms, by phone, by text, or in person), you agree to receive text messages from Carplex, which may include appointment reminders, service and account notifications, responses to your inquiries, and — only if you separately opt in — marketing messages. Some messages may be sent by an automated system, including an AI assistant.

Message frequency varies. Message and data rates may apply.

10. Accessing, modifying, and deleting your data

If you have any questions or want to know which personal data we have about you, please contact us. Please make sure to always clearly state who you are, so that we can be certain that we do not modify or delete any data of the wrong person. We shall provide the requested information only upon receipt of a verifiable consumer request.

10.1 Your rights with respect to your personal data

You may submit a request for access to the data we process about you.
You may object to the processing.
You may request an overview, in a commonly used format, of the data we process about you.
You may request correction or deletion of the data if it is incorrect or no longer relevant, or ask to restrict the processing of the data. Note that we may be legally required to retain certain data (for example, financing records) even after a deletion request; in that case we will tell you what we must keep and why.
You may appeal our decision whenever we refuse to take action on a request, and submit a complaint with the competent authority if your appeal is denied.

10.2 Supplements — Indiana (ICDPA)

Indiana

This section, which supplements the rest of this Privacy Statement, applies to citizens and legal permanent residents of Indiana.

Right to data portability. When exercising the right to access personal data, you have the right to obtain the personal data in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance. You may exercise this right no more than two times per calendar year.

Right to opt out. You may submit a request directing us not to make certain disclosures of personal information we maintain about you. Under the ICDPA this concerns the following purposes:

targeted advertising;
the sale of personal data; or
profiling in furtherance of decisions that produce legal or similarly significant effects concerning a consumer; or
the processing of sensitive data.

12. Children

Our website is not designed to attract children and it is not our intent to collect personal data from children under the age of consent in their country of residence. We therefore request that children under the age of consent do not submit any personal data to us.
